Criminal Defense Lawyers in Vaughan
Vaughan sits at the meeting point of Highways 400, 407 and 427, with large industrial areas, busy shopping centres and fast-growing neighbourhoods. That mix brings a steady flow of vehicle theft, stolen property, impaired driving and assault charges, investigated by York Regional Police and heard at the courthouse in Newmarket.
Provident Law LLP’s partners defend Vaughan residents and people charged while passing through the city. We move quickly on bail, because new federal rules have made release harder in some vehicle theft cases.

Auto Theft and Stolen Property Charges in Vaughan
Vehicle theft has been a major enforcement priority across the GTA, and Vaughan’s highway access and industrial yards make it a focus for investigators. Charges in these cases range from a single count of possession of a stolen vehicle to allegations of organized theft involving many cars.

New Reverse-Onus Bail Rules for Auto Theft
Since July 15, 2026, the federal Bail and Sentencing Reform Act creates a reverse onus for vehicle theft that involves violence or is connected to organized crime. In those cases you must show the court why you should be released, instead of the Crown proving why you should be held. The law also requires consecutive sentences for violent auto theft. A strong, documented release plan and a well-prepared surety are now essential, and we start building them as soon as you call.
Possession of a Stolen Vehicle or Property
Many people charged in Vaughan were not accused of stealing anything. They were found driving, storing or selling a vehicle or goods the Crown says were stolen. To convict, the Crown must prove you knew, or were wilfully blind to the fact, that the property was obtained by crime. We look closely at how you came to have the item, what you paid, what you were told and whether anything should have raised suspicion.
Searches of Vehicles, Yards and Shipping Containers
Organized theft investigations often involve tracking devices, warrants for storage yards and searches of shipping containers before vehicles are exported. Each step must comply with section 8 of the Charter. We review the grounds for every warrant and tracking order, the scope of each search and the chain of custody for seized vehicles. Evidence obtained unlawfully can be excluded, which may leave the Crown without a case.

What clients say
I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.
I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.
I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.
It was an honorable pleasure working with Armandeep Gill. He was very professional and communicative in helping my son beat his criminal charges. I would highly recommend him for his services.

Vaughan Criminal Lawyer FAQs
-
Normally the Crown must justify keeping you in custody. In a reverse-onus case, you must persuade the court that you should be released. It does not mean bail is impossible. It means your plan must be detailed and believable: where you will live, who will supervise you, how you will get to work and what conditions will address the court's concerns.
-
You can be charged, but driving a stolen car is not enough on its own for a conviction. The Crown must prove you knew it was stolen or deliberately avoided finding out. Evidence such as a damaged ignition, missing keys or a very low price can matter. So can an innocent explanation, like borrowing the car from someone you trusted. We test every piece of that evidence.
-
Police can hold seized property as evidence, and a court can order its return or forfeiture. If the vehicle is yours and legally owned, we can ask the Crown or the court to release it, sometimes before the case ends. If an insurer or another person claims the vehicle, the court decides who is entitled to it. Keep all your purchase and ownership documents.
-
Police generally need a judge's authorization, called a tracking warrant, to install a tracking device or obtain ongoing location data, and they do not have to tell you while the investigation is active. After charges are laid, the warrant and the material used to get it should be disclosed. We review whether the authorization was properly obtained and whether police stayed within its limits.
-
Large vehicle theft investigations often produce huge amounts of disclosure, including surveillance logs, phone records and data from tracking devices, which can take months to review. Cases with several accused can take longer still. The Charter's 18-month and 30-month ceilings still apply, and delay caused by the Crown can lead to a stay. We push for complete disclosure early and track every delay.
