Criminal Defense Lawyers in Markham

Markham is one of the GTA’s major business and technology centres, and that shapes the criminal cases that come out of it. Alongside everyday charges, we see allegations of employee fraud, breach of trust, identity fraud and misuse of computer systems, often after months of internal investigation by an employer or bank.

Provident Law LLP’s partners defend Markham residents and professionals charged by York Regional Police. In document-heavy cases, careful review of the financial evidence is often where the defence is won.

Employee Fraud and Theft From an Employer

Many fraud charges in Markham begin with an employer’s internal audit or a bank’s investigation, which is then handed to police. Those reports are written to support a complaint, not to be fair to you. We examine who had access to accounts, whether transactions were authorized, how losses were calculated and whether the evidence actually proves dishonest intent. Bookkeeping errors, unclear policies and shared passwords can all raise reasonable doubt.

Identity Fraud and Online Offences

Allegations involving stolen identity information, online purchases, cryptocurrency or unauthorized access to computer systems depend on digital evidence: IP addresses, device logs and account records. That evidence must be properly obtained and properly linked to you. We review production orders and search warrants, test whether a device can be tied to a specific person, and retain digital forensic experts when the Crown’s conclusions go further than the data supports.

Restitution and Resolution in Fraud Cases

In many fraud cases, repaying the loss can change the outcome. Restitution can support a withdrawal, a peace bond or a discharge, and it is a major factor at sentencing. But offering to repay before you have legal advice can be treated as an admission. We negotiate restitution through counsel, on terms that protect your position, and only when it is in your interest.

I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.

I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.

I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.

Frequently Asked Questions

  • Repayment does not automatically end a criminal case, because the Crown prosecutes on behalf of the public, not the complainant. However, full restitution is often a major factor in resolution discussions and can lead to a withdrawal or a non-conviction outcome. Any repayment should be negotiated through your lawyer so it is not treated as a confession.

  • Police need a warrant or another legal authority to search your devices, except in limited urgent situations. If your devices were seized, the search must stay within the limits of the warrant. Do not delete files or accounts after an investigation begins. We review whether the search was lawful and can ask the court to exclude evidence obtained in breach of your rights.

  • That depends on your employer, your role and your release conditions. Some bail conditions prohibit handling money or holding positions of trust, which can affect your job. We can ask the Crown for conditions that let you keep working where that is safe and appropriate, and advise you on whether to disclose the charge.

  • Theft involves taking or converting someone else's property without their consent. Fraud involves deceit, falsehood or other dishonest conduct that deprives someone of property, money or a service, or puts it at risk. The same events can sometimes be charged either way. The difference affects what the Crown must prove, so we examine whether the right charge was laid.

  • Banks and employers often report suspected fraud and may share some information with police voluntarily. For more detailed records, police usually need a production order or warrant from a judge. Whether the records were obtained lawfully, and whether they were properly interpreted, are important questions. We review how every financial record reached the police file.

  • Fraud investigations can take months or even years, because police often need production orders for bank records, statements from many witnesses and an analysis of the losses. During that time you may hear nothing at all. If you know you are under investigation, getting advice early lets us respond to police contact, protect relevant documents and prepare for the possibility of charges.
