How is property divided in Ontario divorce?
Ontario follows equalization rules where each spouse is entitled to half the increase in family property during marriage. The matrimonial home receives special treatment regardless of ownership. Pre-marital assets and inheritance may be excluded.
What happens to the family home?
The matrimonial home can be sold and proceeds divided, one spouse can buy out the other’s interest, or exclusive possession can be awarded. Both spouses have equal rights regardless of whose name is on title.
How are businesses and investments valued?
Professional valuators assess business worth considering income, assets, market value, and goodwill. Investment portfolios are valued at fair market value on valuation date. Future earnings may be considered for professional practices.
Can I keep my inheritance or gifts?
Inheritance and gifts received during marriage are generally excluded from division if kept separate. However, if used for family purposes or mixed with family assets, they may become subject to equalization.
What if my spouse is hiding assets?
We use various discovery methods including financial disclosure requirements, court orders for document production, forensic accounting, and asset searches. Hidden assets can result in unequal division favoring the innocent spouse.
