Barrie Criminal Lawyers for Highway, Boating and Snowmobile Charges
Barrie sits at the gateway to cottage country. Every summer weekend, Highway 400 fills with traffic heading north, and boats crowd Kempenfelt Bay and Lake Simcoe. Every winter, snowmobiles and ice huts take over the lake. Police enforcement follows the seasons, and many charges we see in Barrie involve impaired operation of a car, boat or snowmobile.
Provident Law LLP defends Barrie residents and visitors charged by Barrie Police Service, South Simcoe Police, the OPP and OPP marine units. Our partners make the drive up Highway 400 for trials and key hearings, and handle early steps by video where the court allows.

Impaired Boating on Lake Simcoe
Operating a boat while impaired, or with a blood alcohol concentration of 80 or more, is the same criminal offence as impaired driving, with the same minimum penalties. In Ontario, a conviction for impaired boating can also lead to the suspension of your driver’s licence. Marine units patrol Lake Simcoe and Kempenfelt Bay, particularly on long weekends. Testing on the water raises unique issues, such as how samples were taken on a moving vessel and how long it took to reach shore, and we examine each of them.
Snowmobiles, ATVs and Off-Road Vehicles
Snowmobile and ATV riders can be charged with impaired operation whether they are on a trail, a frozen lake or a roadway. Stops often happen at trail checkpoints or after a crash. Riders are sometimes surprised that the penalties match those for car drivers. These cases can raise questions about how and where the stop happened, whether the testing equipment worked properly in cold temperatures, and whether the rider was actually operating the machine.
Highway 400 Stops and Mandatory Alcohol Screening
Police can now demand a roadside breath sample from any driver they lawfully stop, without needing to suspect drinking. On busy Highway 400 weekends, that means many cottage-bound drivers are tested. A fail or refusal leads to roadside suspensions and criminal charges. The stop itself, the screening device, the timing of the demand and your access to counsel must all meet legal requirements. We review each one, often using the cruiser’s video.

What clients say
I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.
I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.
I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.
It was an honorable pleasure working with Armandeep Gill. He was very professional and communicative in helping my son beat his criminal charges. I would highly recommend him for his services.

Yes. In Ontario, a Criminal Code conviction for impaired operation of a boat leads to the same driver's licence suspension as impaired driving, even though you were on the water. The court can also prohibit you from operating a vessel. Because the consequences reach your daily driving, these charges deserve the same careful defence as a road case.
-
Yes. Impaired operation laws apply to snowmobiles and other motor vehicles wherever they are operated, including on frozen lakes and trails. The location can still matter to your defence, for example in how police came to stop you and whether the testing was done properly. We look at every detail of where and how the stop took place.
-
Not always. Many early appearances can be handled by your lawyer or by video, so you may only need to return for a trial or plea. Your case stays in Barrie because that is where the charge was laid. Our partners regularly travel north for court, so you do not need to hire a separate local lawyer.

Under the Criminal Code, yes. Operating a motorized boat while impaired, or with a blood alcohol concentration of 80 milligrams or more within two hours of operating, carries the same criminal consequences as driving a car. Open alcohol on boats is also regulated by Ontario law. The safest rule is the same as on the road: do not operate after drinking.
-
Yes. It is an offence to have care or control of a vehicle or vessel while impaired or over the limit, even if it was not moving. Sitting in the driver's seat creates a presumption of care or control. The defence can argue there was no realistic risk of danger, for example where the person had a safe plan to get home. The details matter greatly.
