From Arrest to the Bail Courtroom
After an arrest, Toronto Police either release the person with a notice or undertaking, or hold them for a bail hearing. Those held are brought before a justice, generally within 24 hours. At the bail centre, the Crown reviews the file, decides whether to consent to release or seek detention, and the case is called when a courtroom is free. Hearings can take hours to be reached, so an early call to a lawyer gives us time to prepare.
Coming to Court as a Surety
If you plan to act as a surety, bring government photo identification, proof of address and information about your income and assets. Expect questions under oath about your relationship with the accused, your schedule, your home and how you will supervise them. We meet sureties before they testify, explain every question they are likely to face, and make sure they understand the money they are pledging and their duty to report breaches.
When the Crown Opposes Release
A contested bail hearing involves evidence about the allegations, the accused’s background and the plan for supervision. The justice considers whether detention is needed to ensure attendance in court, to protect the public or to maintain confidence in the justice system. With the July 2026 bail reforms, more cases are reverse-onus. We answer each concern with specific terms, such as a residential surety, a curfew or electronic monitoring where appropriate.

What clients say
I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.
I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.
I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.
It was an honorable pleasure working with Armandeep Gill. He was very professional and communicative in helping my son beat his criminal charges. I would highly recommend him for his services.

North York Criminal Lawyer FAQs
-
Once bail is decided, the case is usually adjourned to a first appearance at the Toronto Courthouse at 10 Armoury Street. Your release order will list that date. Many first appearances can be done by video or by your lawyer. If you are detained, we can bring a bail review in the Superior Court of Justice at 361 University Avenue.
-
Direct contact can be limited while someone is in custody, and calls from cells may be recorded. A lawyer can speak with them privately, explain the process and gather what we need for a release plan. Do not discuss the allegations with them on any recorded line, because those conversations can become evidence. .
-
Release without a surety is still possible, especially for less serious charges or when the accused has no record. The court may release the person on their own undertaking with conditions. If a surety is needed and none is available, we look at alternatives such as a bail supervision program and present a plan that answers the court's concerns.
-
Yes. If a justice orders detention or imposes conditions that are unreasonable, either side can ask the Superior Court of Justice to review the decision. A bail review is not a fresh hearing; it generally requires showing an error in the original decision or a material change in circumstances, such as a new surety. We assess quickly whether a review is likely to succeed and prepare it.
-
If bail is denied, the person stays in a provincial jail while the case continues. That does not end the matter. We can bring a bail review, look for a new surety or plan, and push for an early trial or resolution. Time spent in custody before sentencing is usually credited if there is a conviction, but the goal is to avoid unnecessary custody altogether.
