The difference between possession and trafficking can mean the difference between diversion and years in prison.

Possession for the Purpose of Trafficking
Most serious drug cases are charged as possession for the purpose of trafficking. The Crown rarely has direct proof of a sale; instead it relies on the amount of the drug, how it was packaged, scales, cash and messages on phones, often with an officer giving an opinion about what those items mean. We test that opinion. Personal use, sharing among friends and innocent explanations for cash or multiple phones can all raise reasonable doubt.
Dial-a-Dope Investigations and Entrapment
In a dial-a-dope investigation, an officer calls a phone number believed to be used for drug sales and arranges a purchase. The Supreme Court of Canada has held that police must have reasonable suspicion about the specific person or phone number before offering an opportunity to sell drugs. If they did not, it may be entrapment, and the charges can be stayed. We demand the details of the tip and every step taken before the call.
Fentanyl Cases and Sentencing
Fentanyl trafficking is treated with great seriousness because of the overdose deaths it causes, and sentences can be significant. In 2022, Parliament repealed the mandatory minimum sentences for drug offences under the Controlled Drugs and Substances Act, giving judges more flexibility. That makes the defence presentation at sentencing, including addiction, treatment, background and the actual role played, more important than ever.

What clients say
I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.
I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.
I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.
It was an honorable pleasure working with Armandeep Gill. He was very professional and communicative in helping my son beat his criminal charges. I would highly recommend him for his services.

Hamilton Criminal Lawyer FAQs
-
The Good Samaritan Drug Overdose Act protects people who call 911 or emergency services for an overdose, and people at the scene, from charges for simple drug possession and certain related breaches. It does not protect against trafficking charges, outstanding warrants or other offences. If you were charged after seeking help for someone, tell us, because the protection may apply to part of your case.
-
Not automatically. The Crown must prove you knew the drugs were there and had some control over them. Being in the same car or home is not enough on its own. Where the drugs were found, who had access, whose belongings were nearby and what each person said all matter. Shared spaces often create reasonable doubt about who possessed the drugs.
-
For simple possession, yes in many cases. Federal law now directs police and prosecutors to consider warnings, referrals to treatment and diversion before charging or prosecuting simple possession. Diversion is much less likely for trafficking charges. We present any treatment, counselling or support you have to make the strongest case for a non-criminal outcome.

A Garofoli application challenges a search warrant by testing whether the information police swore to obtain was enough to justify the search. The defence can argue that the information was misleading, incomplete or based on unreliable tips. If the judge finds the warrant should not have been issued, the evidence from the search may be excluded, which often ends a drug case.
-
Not automatically. Police often seize cash found with drugs and the Crown may seek forfeiture, arguing it is proceeds of crime. If the money came from legitimate sources, such as wages or savings, we can apply for its return with records like pay stubs, bank withdrawals and tax returns. Keep any documents that show where the money came from.
