Criminal Defense Lawyers in Newmarket

The Crown Pre-Trial
The Crown pre-trial is often the most important meeting in a York Region case. The Crown sets out its position and any offer to resolve the case, and we respond with the weaknesses we found in the disclosure, any Charter problems and information about you that the Crown may not know. A well-prepared defence at this stage frequently leads to a withdrawal, diversion or a much better offer than the one first put on the table.
The Judicial Pre-Trial
In a judicial pre-trial, a judge who will not hear your trial meets privately with the Crown and defence. The judge may give a candid view of the strengths of each side and the likely sentence if you were convicted. This can help both sides see the case realistically. Your participation is usually through your lawyer, and what is said cannot be used at trial.
Preparing for Trial
Trial preparation starts long before the trial date. We file Charter applications on time, interview witnesses, retain experts where needed and prepare you to testify if you choose to. We also prepare detailed cross-examinations of each Crown witness based on their statements and notes. Many cases resolve on or just before the trial date because the Crown sees the defence is ready.

What clients say
I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.
I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.
I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.
It was an honorable pleasure working with Armandeep Gill. He was very professional and communicative in helping my son beat his criminal charges. I would highly recommend him for his services.

Newmarket Criminal Lawyer FAQs
-
Not always. In most cases, your lawyer can file a designation of counsel, which allows the lawyer to appear on your behalf for routine appearances. You must still attend in person when the court requires it, such as for your trial, a guilty plea or a sentencing hearing, unless the judge permits otherwise. We will tell you clearly which dates need you.
-
Disclosure is the Crown's evidence: police notes, witness statements, video, photos and lab reports. You are entitled to all relevant disclosure so you can make full answer and defence. Initial disclosure is usually available at or soon after the first appearance, with more added later. We review every item and push for anything missing.

Simple cases that resolve early may finish in a few months. Cases that go to trial in the Ontario Court of Justice often take a year or longer. The Charter requires a trial within a reasonable time, and long delays caused by the Crown or the court can lead to a stay. We keep the case moving and avoid defence delay.
-
A Charter application asks the court to find that police or the Crown breached your constitutional rights, for example through an unlawful search, a delayed call to a lawyer or unreasonable trial delay. If the judge agrees, the remedy can include excluding evidence or staying the charges. These applications must be filed in writing before trial, with notice to the Crown, so we prepare them early.
-
Arrive early, dress as you would for an important meeting and meet us before court begins. Trials can be delayed while other matters are dealt with, so plan to be at the courthouse all day. The Crown calls its witnesses first, we cross-examine them, and then you decide with us whether to call evidence. The judge may give a decision that day or later.
