Criminal Defense Lawyers in Burlington

A domestic assault charge in Burlington can change your life overnight. Within hours, release conditions may stop you from going home, seeing your partner or, in some cases, contacting your children. At the same time, a separation may be starting, with questions about the house, support and parenting. The criminal case and the family case are now connected, whether you want them to be or not.

Provident Law LLP practises both criminal defence and family law. That means your defence strategy can account for your family matters from the start, so a step in one case does not damage the other.

No-Contact Conditions and the Family Home

Most domestic charges come with a condition not to contact the complainant and not to attend the home. That applies even if you own the house and even if the complainant invites you back. Breaching it is a new criminal charge. We can arrange for you to collect belongings with a police escort, and we work to vary conditions when it is safe, for example to allow contact through a third party about the children or finances.

Parenting While a Charge Is Pending

Criminal conditions may limit contact with your children, especially if they were present during the alleged incident. Family court orders cannot simply override those conditions, so the criminal conditions usually need to be varied first. Family courts also consider family violence when deciding parenting arrangements. We coordinate both processes so that your time with your children is restored as quickly and safely as possible. Learn more about our parenting services.

What You Say in Family Court Matters

In family proceedings, you may be asked to swear an affidavit describing what happened in the relationship. Those sworn statements can be obtained by the Crown and used against you in the criminal case. The reverse is also true. Before you file anything in family court, your criminal lawyer should review it. Because our firm handles both areas, we can make sure your family filings and criminal defence say the same thing.

I just recently attended court today in Brampton and my lawyer was Arman Gill. My charges of breach of long-term supervision have been successfully withdrawn from the courts today. In regards, I am leaving a review and letting your firm know that your services were awesome and I am so happy that I don't have to face any jail time. Once again, your services at your law firm were awesome.

I had serious charges against me and, as an international student, dealing with legal issues is not easy, but Arman Gill always had my back and helped me by going above and beyond. Not only on weekdays, he always answered my calls even on weekends and after office hours. I never saw a lawyer with this much dedication to helping their clients. He got all my charges withdrawn at pre-trial with a peace bond. He always talked about my future and what I wanted as a result, and fought as hard as possible to get the best outcome for me.

I worked with Mr. Arman Gill, who helped my son obtain an absolute discharge, and I couldn't be more grateful. From our first meeting, he was knowledgeable and incredibly thorough. He explained every step of the process clearly and made us feel supported throughout. Thanks to his expertise, my son received the discharge and can now move forward with his life. Highly recommend to anyone facing similar challenges.

Burlington Criminal Lawyer FAQs

  • If your conditions bar you from the home, do not go back on your own, even briefly. Police can usually arrange a one-time escort to collect clothing, medication, work tools and important documents. We can help organize this and, if you need more, negotiate a further retrieval through counsel. Make a list in advance so the visit is quick and uneventful.

  • It can. Under Canadian family law, courts consider family violence when deciding parenting time and decision-making responsibility. A pending charge is not a finding of guilt, but it can shape interim arrangements. The outcome of the criminal case, such as a withdrawal or peace bond, often affects the family case too. That is why we plan both cases together.

  • Your partner can tell the Crown they want contact restored, and that can help, but the decision is not theirs alone. The Crown or the court must agree to vary the condition. Often a variation is possible after a period of time or with safeguards such as counselling. Never resume contact on your own, even if your partner wants it.

  • The Partner Assault Response program is a group education and counselling program used in Ontario domestic cases. Completing it can be part of a resolution, such as a peace bond or a discharge, or can be a condition of probation. Starting counselling voluntarily, before it is required, can also help in negotiations. We advise you on whether and when to enrol.

  • If the case goes to trial, the Crown can require the complainant to testify by serving a subpoena, even if they no longer want the case to continue. Spouses can generally be compelled to testify in cases involving violence against them. What they say in court can differ from their original statement, and we are prepared to address that through careful cross-examination.
